The electoral process witnesses many disputes all over the world. It could not be argued that the proper handling of the correct procedures of these disputes will have a considerable impact on the degree of credibility and integrity of the entire electoral process and the voter confidence; nonetheless, the establishment of mechanisms for settling electoral disputes to ensure dealing effectively with any irregularities that may arise in any stage of the electoral process is to ensure the credibility and transparency of the Electoral Event and to ensure the rights and obligations of all parties, whether voters or candidates.

There are various mechanisms for settling the electoral disputes around the world, and unquestionably, there is no “optimal” system to deal with it.

However despite the abundances of these mechanisms among giving these powers to an electoral management body, or a particular court, whether within Administrative or ordinary Courts, whereas the common feature of these mechanisms in the Arab world is the vital role of Administrative Judiciary in settling these conflicts, even if those mechanisms were different.

 

Although there are multiple mechanisms in settling the electoral disputes, and there are many parties and institutions that undertake that responsibility, there are fundamental principles that shall be assured to ensure the Electoral Justice.

 

The basic thought

Here comes the aim for more understanding and awareness of the settlement of electoral disputes and the role of stakeholders from the electoral management body to the highest litigating degree in the State. From this standpoint, the Arab Union of Administrative Judiciary is organizing this conference, during which we will review the international and regional experiences from different countries concerning the settlement of electoral disputes, the Conference will be held in Cairo On

the 8th, 9th of January 2018.

The General Objective

Review the best practices in the Arab States and EU member states as well as the various international and regional practices with respect to the settlement of electoral disputes.

The Main Aim

  • Exchange of expertise and the awareness mechanisms for settling disputes between the parties of the electoral process, while focusing specifically on the best international practices.
  • Identify all forms and types of electoral disputes, such as the complaints and appeals, with exposing the roles of the various institutions in dealing with them.
  • Strengthening the relations between all parties concerned with the electoral process in the region through the conference and its sessions.

 

The participants

The conference includes participants from among the members of the Arab Union of Administrative Judiciary and other concerned parties such as electoral commissions, experts and professionals from around the world, as well as the electoral management body in Egypt and representatives of various ministries in such fields, judicial authorities, political parties, parliamentarians and the media.

 

The methodology

Conference will  take place on  two consecutive –days, will include the opening and closing sessions, in addition to presentations, discussions as well as working groups, and there will be simultaneous translation in English and French.
